Terms and Conditions

Gift Card Terms of Use: 

1 - Overview 

These Terms of Use govern the purchase, ownership, and redemption of gift cards (“Gift Cards”) issued by Surf & Sand Laguna Beach (“the Resort”). By purchasing or using a Gift Card, the holder agrees to these Terms and all applicable California laws, including California Civil Code §1749.5. 

2 - No Expiration Dates 

Gift Cards issued by the Resort do not expire. Any Gift Card sold without an expiration date remains valid until fully redeemed or replaced, as required by California law. 

3 - No Fees 

The Resort does not charge any fees related to the purchase, activation, maintenance, dormancy, or redemption of Gift Cards, except where expressly permitted under California law. 

4 - Cash Redemption of Low Balances 

In accordance with California Civil Code §1749.5, Gift Cards with a remaining balance of less than $10 must be redeemable for cash upon request. 

5 - Replacement of Lost, Damaged, or Defective Cards 

Gift Cards sold after January 1, 1997, are eligible for replacement at no cost if damaged, unreadable, or otherwise unusable, provided the guest can present proof of purchase or sufficient identifying information. 

6 - Promotional & Donated Gift Cards 

Gift Cards donated to nonprofit or charitable organizations without receiving payment may be exempt from cash-out requirements if they include a clear disclaimer in at least 10-point font. These cards may include additional restrictions, which will be disclosed at issuance. 

7 - Use of Gift Cards 

Gift Cards may be used for eligible purchases at Surf & Sand Laguna Beach, including lodging, dining, spa services, activities, and retail (as applicable). 

Gift Cards cannot be redeemed for cash, except as required under the low-balance cash-out rule. 

Gift Cards may not be used for unlawful or unauthorized transactions. 

8 - Fraud & Misuse 

The Resort reserves the right to refuse, cancel, or hold Gift Cards suspected of fraud, unauthorized resale, or misuse. 

9 - Limitation of Liability 

The Resort is not responsible for lost or stolen Gift Cards unless replacement is required under California law and sufficient proof of purchase is provided. 

10 - Changes to Terms 

The Resort may update these Terms to comply with changes in law or operational needs. Updated Terms will be posted on our website and apply to future purchases.
